These Terms and Conditions are governed by English law and are subject to the non exclusive jurisdiction of the English courts. We do not accept amendments to these Terms and Conditions. Failure by us to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these terms and conditions.

We can also accept telephone orders - please call 0191 285 8877 10am-5pm Monday - Friday 10am-4pm Saturdays.

Online Orders (at this website)

Your order is sent directly to our secure till in our high street shop in Gosforth, Newcastle upon Tyne for processing. Once we have received your payment, our staff will pick and pack the item. We will aim to do this the same day for all orders Monday to Saturday (excl Bank Holidays). Orders received by us before 10am will be sent out the same day, or Monday if your order was placed over the weekend. Orders received after 10am will be sent out the next working day.

You can track the progress of your order at any time by logging into the ‘My Account’ section from the Homepage on this website.

Pricing Information

The total price payable will be stipulated at the time when you place your order, whether or not the order has been acknowledged. We are entitled to make adjustments to the price to take account of any increase in our suppliers’ prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been acknowledged. In this case we will inform you of the correct price and give you the opportunity to cancel the order.

All prices displayed on our website are inclusive of VAT at the current rate but exclusive of delivery charges which will be added on at the time the order is placed - you will be given the option of selecting local collection (free), UK delivery, worldwide delivery etc when you go to the checkout stage. If you are directed to our site from a third party website the prices displayed on our website may be different.

Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If a product becomes unavailable we may offer you an alternative or suggest that you visit our store.

We use the industry leading internet payment company Protx to protect your card details and protect us from fraud. The following security systems are used. Transaction Security. All transaction information passed between merchant sites and the Protx VSP Systems is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to your servers from Protx are signed using MD5 hashing to prevent tampering. You can be completely secure in the knowledge that nothing you pass to Protx servers can be examined, used or modified by any third parties attempting to gain access to sensitive information. Encryption and Data Storage. All sensitive data is secured on Protx using the same internationally recognised 256-bit encryption standards used by, among others, the US Government. The encryption keys are held on state-of-the-art, tamper proof systems in the same family as those used to secure VeriSign’s Global Root certificate, making them all but impossible to extract. Links to Banks. Protx has multiple private links into the banking network that are completely separate from the Internet and which do not cross any publicly accessible networks. Any cardholder information sent into the banks and any authorisation message coming back is secure and cannot be tampered with.

Delivery and Postage Costs

We are only able to deliver to the UK. UK Orders are sent out by courier and postage and packing is charged at £6. Orders over £50 are sent out free of charge. You can also collect in person from our shop in Gosforth, Newcastle upon Tyne. Non UK, worldwide, european and BFPO postage is £10. We can however deliver outside of the UK but please contact us first either by phone on 0191 285 8877 or by email to TLM@blueyonder.co.uk

Delivery is charged as priced and quoted on each order.

Delivery is normally within 48 hours and requires a signature so please ensure you provide an address where someone will be able to receive the goods during work hours. You can also collect from our store in Newcastle upon Tyne. If you are unavailable when our delivery partner tries to deliver your order, they will usually try to deliver again the next working day or they will drop a card in to offer you a collection from a local collection point. If you should refuse delivery of goods, or are not available to accept the delivery or do not collect your items from the postal depot so that they are returned to us you will be required to cover any extra costs incurred to resend your items out to you.

We will only deliver goods to the address on the order.

On occasion goods are subject to availability and delay in delivery of goods is sometimes outside our control. As such, delivery cannot be guaranteed and any dates we specify for the delivery of the goods are approximate only. We shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods.

No Quibble Returns Policy

The following does NOT apply to faulty goods or goods that have been damaged in transit. See later for details .

We want you to be delighted with your order so if you are unhappy with a product for any reason just send it back to us (but please email us first) and we will refund the full price that you paid for the item or send you an exchange. Unfortunately the postage and packing costs incurred in the delivery of the goods to you cannot be refunded except in the case of cancellations or faulty products. We only ask that you return the goods within 28 days in perfect condition, unused and in their original packaging and with all the original tags (where applicable) intact otherwise we may not be able to refund you or replace the goods. If you wish to return an item after 28 days please just email us and we’ll try our best to accommodate you.

For your peace of mind we will email you as soon as we receive your returned goods.

We are sorry but you will be responsible for the packaging and postal cost of returning the goods to us and will remain responsible for those goods until they reach us. Therefore we strongly advise that you obtain a proof of postage certificate when returning your goods to us. These are easily available from the Post Office. If you have any questions regarding this please call us on 0191 285 8877 and we will try to help you as best we can.

We try to process all returns within 48 working hours of reaching us and will email you to confirm when this has been done. Sometimes the limitations of the banking system mean that the refund may take a further few days to show up on your card etc statement.

Items returned outside our generous (we think!) 30 day period will only be accepted if the return has been authorised by our customer service team prior to receipt of the item/s by us. Please email us in such cases BEFORE you send anything back to us as you will need a special returns form which we will send out to you. We cannot accept any returns without this form!

Returning Damaged or Faulty Goods

Hopefully you will never receive a faulty or damaged item (unless it has been damaged in the post) but unfortunately mistakes happen.

If this is the case you are entitled to a full refund (including the postage costs) without question. We will also fund the postage cost of you returning the item to us. Accuracy and Portrayal of Products

While every effort has been made to portray items accurately through descriptions and images, slight variations may occur in colour, size etc. All measurements quoted are approximate (but as close as possible!) and the reproduction of colours is as accurate as photographic and web publishing processes will allow.

All products comply with appropriate safety and consumer regulations. Toys comply with EC Toy Safety Regulations and, where appropriate, carry the CE mark. If a product is recalled for any reason, you will be contacted. Age and safety guides are provided for each item as quoted by the manufacturer and TLM Ltd cannot be held responsible for any event arising from the use of any item shown on this website.

Our Recommended Age

A product’s age range as noted on each product page (where stated) is provided by the product manufacturer. This suggested age range my be based on what age range of child the manufacturer considers will enjoy the product best. It could also be based on safety guidelines or restrictions.

AvailabilIty of Products

All items are subject to availability however our software removes any product automatically from our site if it is out of stock. Unfortunately computers aren’t infallable and so we will inform you as soon as possible if goods you have ordered are not available and you will be offered a refund.

Cancellation or Changing Your Order

Once your order has been placed and confirmed by us we are very sorry but we cannot make alterations or cancellations. This is because as soon as your order reaches us, it is rushed through to be packed and sent. To make an alteration at this point would involve stopping the packing process and would mean delayed parcels for everyone.

Liability Disclaimer

TLM’s total liability for any claim howsoever shall not exceed the price of the goods supplied by TLM to the customer. TLM shall not be liable for any consequential loss whether this arises from a breach of duty in contract or in any other way, save where such liability is imposed upon TLM by statute. TLM cannot accept any liability for a failure to comply with instructions specifically stated in the catalogue. TLM does not limit in any way our liability for death or personal injury caused by our negligence or willful misconduct. By law, you also have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered. Goods are provided to you on approval and legal title to the goods will not pass to you until [14] days after delivery. Your statutory rights are not affected by this statement.

TLM endeavours to check the accuracy of the information on this site. However, TLM does not warrant that such information will be error free and the user acknowledges that information, products and services published on this web site may include inaccuracies and typological errors. If the goods do not on receipt by you substantially meet the description on this web site, you are entitled to reject the goods and return them to us.
